1. General information

This privacy policy sets out the rules for processing personal data and using cookies on the website available at mikojsoft.pl (the "Website").

The controller of personal data is MikojSoft Grzegorz Synowiec (the "Controller"). You can contact the Controller by e-mail at [email protected] or by phone at +48 509-730-437.

2. Scope of processed data

The Website is informational in nature and does not contain forms collecting personal data. The Controller processes personal data only in the following situations:

• E-mail or phone contact — if you contact the Controller, the data you voluntarily provide (e.g. name, e-mail address, phone number, message content) will be processed in order to handle your enquiry and, where applicable, prepare an offer.
• Analytics data — the Website uses Microsoft Clarity, a tool that automatically collects information about how the Website is used (details in section 4).

3. Purposes and legal bases of processing

Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), for the following purposes:

• responding to enquiries and conducting correspondence — the legal basis is the Controller's legitimate interest (Art. 6(1)(f) GDPR) or taking steps prior to entering into a contract at the request of the data subject (Art. 6(1)(b) GDPR);
• analysing how the Website is used and improving its quality — the legal basis is the user's consent expressed via the cookie banner and the Controller's legitimate interest (Art. 6(1)(f) GDPR).

Providing data is voluntary but necessary to receive a response to your enquiry.

4. Cookies — Microsoft Clarity

The only tool using cookies on the Website is Microsoft Clarity — an analytics service provided by Microsoft Corporation (One Microsoft Way, Redmond, WA 98052, USA) and Microsoft Ireland Operations Limited.

Microsoft Clarity helps the Controller understand how users interact with the Website by:

• recording anonymous heatmaps and session recordings (cursor movement, page scrolling, clicks),
• collecting technical information such as device and browser type, screen resolution, approximate location (country/region level) and IP address.

The following cookies in particular may be set as part of the Microsoft Clarity service:

• _clck — stores the Clarity user identifier (retention period: up to 12 months),
• _clsk — links page views into a single session (retention period: 1 day),
• MUID — a Microsoft identifier used for analytics purposes (retention period: up to 13 months).

Data collected by Microsoft Clarity may be transferred to the United States. Microsoft ensures an adequate level of data protection based on the EU–U.S. Data Privacy Framework and standard contractual clauses.

5. Managing cookies

You can manage or delete cookies at any time:

• via your browser settings — you can block cookies from being stored or delete cookies that have already been set,
• by using your browser's private/incognito mode,
• by opting out of Microsoft ad tracking on the Microsoft privacy settings page.

Blocking cookies does not affect your ability to use the Website.

6. Data recipients

Personal data may be shared only with the following categories of recipients:

• Microsoft Corporation / Microsoft Ireland Operations Limited — with regard to analytics data (Microsoft Clarity),
• hosting and e-mail service providers used by the Controller,
• entities entitled to receive the data under applicable law.

7. Data retention period

• data provided in correspondence — for the period necessary to handle the enquiry, and subsequently for the limitation period of any potential claims,
• analytics data (Microsoft Clarity) — in accordance with the periods indicated in section 4; session recordings are stored by Microsoft for 30 days by default, and aggregated data for up to 13 months.

8. Your rights

In connection with the processing of your personal data, you have the following rights:

• the right to access your data and obtain a copy of it,
• the right to rectify (correct) your data,
• the right to erasure,
• the right to restrict processing,
• the right to object to processing,
• the right to data portability,
• the right to lodge a complaint with the President of the Polish Personal Data Protection Office (UODO, ul. Stawki 2, 00-193 Warsaw, Poland).

9. Changes to this privacy policy

The Controller reserves the right to amend this privacy policy, in particular in the event of changes to the law or the tools used. The current version of the policy will always be available on the Website together with the date of the last update.
